Terms & Conditions
Art. 1 General provisions
The web store on the website of Izindlovu Fund, a non-profit organization with registered office at Hertendreef 4, 2970 Schilde with VAT BE0738.518.012 (hereinafter Izindlovu) offers its customers the opportunity to purchase products from its web store online.
These general terms and conditions apply to all purchase and sales contracts concluded by a visitor to this website, hereinafter referred to as “customer”, with Izindlovu Fund, Hertendreef 4, 2970 Schilde, VAT BE0738.518.012. These general terms and conditions shall always prevail over any other terms and conditions of the customer. Additional terms and conditions of the customer are excluded, except when previously, in writing and expressly accepted by us.
Art. 2 Price
All mentioned prices are expressed in EURO, inclusive of VAT and all other Belgian taxes to be paid by the customer and exclusive of import and other taxes charged for shipment to a country outside Belgium.
Art. 3 Online purchases
An agreement is validly concluded when the order is sent electronically by clicking on the “complete order” button, or by sending an e-mail containing an order.
Art. 4 Retention of title
The delivered items remain the exclusive property of Izindlovu until full payment by the Client.
The Client undertakes, if necessary, to inform third parties of Izindlovu’s retention of title, e.g. to anyone who would come to seize the items not yet paid in full.
Art. 5 Right of withdrawal
The customer has the right to notify the seller that he renounces the purchase, without payment of any penalty and without giving any reason within 14 working days from the day following the delivery of the product or the conclusion of the service agreement, provided that the purchased products are returned to Izindlovu in their original packaging and without damage. However, food items cannot be taken back.
The Customer must return or hand over the goods to Izindlovu, Hertendreef 4, 2970 Schilde, without delay, but in any event no later than 14 calendar days from the day on which he communicated his decision to withdraw from the contract to Izindlovu. The Customer is on time if he returns the goods before the period of 14 calendar days has expired.
The Customer hereby bears the costs for the return delivery.
Art. 6 Payment
Payment is always made electronically or by bank transfer. Each order is immediately payable upon conclusion of the agreement.
Art. 7 Execution of the agreement – dispatch and delivery
The execution of the agreement or delivery normally takes place almost immediately after payment. However, any delay in execution does not give any right to compensation. In case of payment by bank transfer, the delivery of the ordered products takes place within five working days after crediting our account. Also in this case, any delay in the execution does not give the right to compensation.
The seller will make every effort to meet the stipulated delivery deadlines, which are only indicated approximately. The buyer may not breach the contract by the mere expiry of the delivery date, nor may he refuse the goods or claim damages or interest. Where applicable, termination is only possible after prior notice of default by registered letter, specifying a reasonable delivery period.
Art. 8 Complaints
Any complaints must be well-founded and duly motivated and notified to us within 8 days after receipt of the goods. Warranty for hidden defects is granted for a non-renewable period of 6 months from delivery and on condition that the seller is notified within 72 hours of discovery.
No goods may be returned without the seller’s prior written consent. This authorization in no way implies recognition by the seller that the returned goods are faulty or non-conforming. The purchaser must show that any damage occurred during transport.

Art. 9 Proof
The Customer accepts that electronic communications and backups can serve as evidence.
Art. 10 Applicable law – Disputes
All disputes arising from this agreement shall be governed by Belgian law. For all disputes arising from this agreement, the Court of Antwerp is competent.
Art. 11 Acceptance of general terms and conditions
With each electronic order of products, the customer expressly declares that he accepts these general terms and conditions.
